3E Company’s suite of Professional Services offers environmental health and safety services to assist customers with a variety of compliance activities related to product safety and stewardship as well as workplace and employee safety. Our staff of highly qualified EH&S professionals includes authors, toxicologists, industrial hygienists, engineers, product stewards, dangerous goods safety advisors, and other specialists well-versed in many areas of hazardous materials and global chemical regulatory compliance.

European Product Registration

A number of European countries have national legislations requiring registration of certain substances and preparations. This legislation is not harmonized at the EU level and is not being changed or impacted by REACH.

The provisions regarding product registration in each of the countries are very different when it comes to which products must be registered and which information is required to be submitted with the registration. In some countries, registered substances and products are assigned a registration number.

If these national provisions on product registration are not complied with, the importer or producer may be subject to penalties such as a fine or the authorities may stop the import/production and sale of the product.

European Product Registration services are supported by 3E Company’s operation in Copenhagen, Denmark, which is home to the Ariel™ Team of global regulatory experts, including MSDS authors, researchers and compliance specialists who are well-versed in global regulations, have direct relationships with many regulatory bodies across the globe, and speak more than 26 languages. There are two options for European Product Registration Services:

Full Outsourcing: For chemical products sold in a European country, the Ariel team can:

  • Determine if the product must be registered, and if so, in which countries
  • Carry out the registration on behalf of the customer
  • Maintain the registration
  • Update SDSs (Safety Data Sheets) and label documents

Compliance Assistance: For companies who want to handle registrations in-house, but need a resource for understanding the requirements, the Ariel team can:

  • Provide basic training of the requirements for product registration, tailored to the company’s specific type of products and business
  • Assist with establishing and implementing company-specific procedures for on-going compliance

Dangerous Goods Safety Adviser Service

The foundation of our Dangerous Goods Safety Adviser Service is the assignment of a lead Dangerous Goods Service Adviser (DGSA) to each customer. Through this relationship, 3E Company is able to develop a thorough understanding of the customer’s business helping to ensure delivery of services that are most effective for the customer’s specific operations. This approach ensures that the independent consultative audit conducted by the 3E DGSA is consistent across sites, best practices are shared across sites, and deliverables reflect the company’s culture and business practices.

Our DGSA’s possess the necessary certifications, global EH&S expertise, and communication skills required to assist our clients in fulfilling the functions of a Dangerous Goods Safety Adviser, as required by the European Agreement Concerning the International Carriage of Dangerous Goods. Backed by a team of multi-lingual EH&S professionals and Ariel’s unrivaled global regulatory compliance database, 3E provides a cost-effective solution to DGSA compliance for manufacturers, distributors, suppliers and other companies involved in the shipment of dangerous goods by road, rail or inland waterway in Europe.

The DGSA services provided by 3E to customers can include:

  • Support for the annual compliance audit of each of the customer’s facilities across Europe which typically includes a review of the dangerous goods activities and compliance actions regarding work procedures, employee training, marketing information, and general housekeeping;
  • Verification that a management system is in place for the shipment of dangerous goods;
  • Preparation of the customer’s dangerous goods annual report for management and public authorities.

Chemical Control Law Services

Chemical Control Law services offer support for the complex and time-consuming tasks associated with regulatory compliance for the Toxic Substances Control Act (TSCA), which can be challenging to develop and maintain internally. These services can be performed on either a project or a contract basis and range from fully outsourcing TSCA compliance activities to outsourcing activities related to importing finished products produced by third party vendors not located in the U.S. for resale in the U.S. Outsourcing minimizes the risk associated with reselling finished products or substances which are not developed by the reseller. Full disclosure of ingredients in a finished product is required to check the finished product against the TSCA inventory, and a non-competitive third party can often obtain that information more easily from manufacturers. 3E is also prepared to advise either the reseller and/or the manufacturer on various exemptions and options in the event that a product cannot immediately be imported and resold as it is currently formulated. 3E’s Chemical Control Law Services provide a cost-effective solution to companies facing the ongoing challenge of ensuring compliance with chemical control laws. The following are examples of the support 3E can provide.

  • TSCA Inventory - Checking the TSCA inventory for substances imported or manufactured, including the ingredients in finished products
  • TSCA R&D Exemption - Advising clients on R&D exemption requirements and setting up procedures to govern related activities
  • Import Certification - Assisting with import certification once the status of the substance or product to be imported has been checked against the TSCA inventory.
  • Export Notification - Establising processes for tracking 12(b) exports and assisting with export notification
  • Adverse Effects - Establishing processes for compliance with adverse effects reporting and recordkeeping
  • Regulatory Tracking - Monitoring and tracking regulatory changes which are likely to impact the client’s business

Chemical and Regulatory Data Management Services

Effective chemical and regulatory data management processes are known to have a positive impact upon internal business processes from enabling generation of high quality hazard communications to improvements in chemical regulatory compliance. 3E’s chemical and regulatory data and document management services provide an outsourced solution for maintaining the chemical and raw material content in the client environment. Services include: contacting suppliers to obtain information and documents of interest; compiling the chemical and regulatory information customers deem important; performing value added services on request, from detection of inconsistencies in information from suppliers to hazard chemical classification, and entering and maintaining of this information in the customer’s authoring platform, ERP system or data warehouse.

The chemical and regulatory data and document management services are backed by 3E’s unparalleled knowledge base of global chemical regulatory information. 3E’s chemical and regulatory data management services can be used with most commercially available EH&S platforms, including SAP®, ProSteward and The WERCS®, as well as with proprietary systems.

Compliance Analysis

3E's team of experienced professionals work closely with a customer to analyze its current EH&S processes and policies. 3E can analyze portions of, or the entire program, including MSDS information and management, hazardous materials spill reporting and clean up, hazardous waste management, storage and disposal, transportation of hazardous materials, EH&S training and implementation, as well as regulatory compliance reporting related to the storage and handling of hazardous materials. The result is a comprehensive written report summarizing the findings, including recommendations for improvement. The service can be further enhanced by an accompanying report that includes a timeline for implementation of any 3E services that address issues that were identified through the analysis, as well as a risk assessment piece that ranks the priority of each area that needs improvement.
