EU Commission Updates Plastics Food Contact Regulation

The European Commission adopted legislation on 2 September 2020 amending several of the annexes to Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food (Plastics FCR).

Verisk 3E Review    

Published 3 September 2020 in the EU Official Journal, Regulation (EU) 2020/1245 adds new substances, amends existing ones, as well as makes clarifications to eliminate certain ambiguities to ensure the regulation is applied correctly. Following are the specific changes listed by annex:

  • Annex I (i.e., Union list of authorized monomers, other starting substances, macromolecules obtained from microbial fermentation, additives and polymer production aids): Two existing entries are updated and three new entries and two verification of compliance notes are added.
  • Annex II (i.e., Restrictions on plastics and articles): This annex has been reissued in its entirety and restructured into a table containing 24 entries, including four lanthanides (La, Eu, Gd, Tb).
  • Annex IV (i.e., Declaration of compliance requirements): information requirements added and clarified for materials at intermediate stages in the supply chain.
  • Annex V (i.e., Compliance testing requirements): number of provisions are added clarifying how migration tests shall be conducted.

Verisk 3E Analysis

Plastic materials and articles that comply with the Plastics FCR before this amending regulation becomes effective and which are first placed on the market before 23 March 2021 may continue to be placed on the EU market until 23 September 2022 and remain on the market until the exhaustion of stocks.
