European trade union and chemical industry organizations have released a statement calling for a change in the legal framework for regulating reprotoxic substances in the workplace, specifically the Chemical Agents Directive (CAD) and the Carcinogens and Mutagens Directive (CMD). The statement proposes combining the two directives for carcinogens, mutagens and reprotoxic substances (CMRs) into one CMR directive.
The envisioned CMR directive would follow the CMD in that the avoidance of exposure would be the general principle, followed hierarchically by risk management measures. Safe levels would be determined and set at the EU-wide level as binding exposure limits, starting with the implementation of current Occupational Exposure Limits (OELs) for reproductive toxicants, health-based or otherwise. The statement concludes that the incorporation of reprotoxicants into the CMD would be the most efficient solution in the short term. An annex to the statement provides key features of a proposed future CMR directive.

The work is entitled “Study to collect recent information relevant to modernising EU Occupational Safety and Health chemicals legislation with a particular emphasis on reprotoxic chemicals with the view to analyse the health, socio-economic and environmental impacts in connection with possible amendments of Directive 2004/37/EC and Directive 98/24/EC.” The work is being completed for the EU’s Directorate General for Employment.
